Employment Disputes

Our clients can rely on the expertise of our lawyers who have experience acting for both employers and employees in employment disputes.

We understand that employment disputes can have a detrimental impact on the wellbeing of employers and employees.

For employers, the costs and damage associated with such disputes can be significant. Even in cases where claims are ultimately unsuccessful and unfounded, claims of unfair termination and discrimination can harm morale, waste valuable resources within the business, and undermine a reputation built over many years.

For employees, the loss of employment, livelihood, and entitlements earned from a lifetime’s work can be extremely distressing.

Our Experience

We work closely with our clients to understand their needs, address potential disputes, and offer the most optimal solutions that suit their unique situations.

  • Reviewing and drafting documents: These may include exit letters, separation agreements, confidentiality agreements, and releases and waivers drafted in contemplation of the end of employment. We also advise on the drafting of employment contracts prior to the commencement of employment.
  • Advising on the lawful termination of employment: We advise on the grounds of termination, the requisite notice period to be given and benefits payable to the departing employee upon termination, termination entitlements, and separation agreements.
  • Advising on the remedies for wrongful termination of employment: We advise on the damages an employee may claim against their employer where their employment was wrongfully terminated, such as by constructive dismissal, summary dismissal, the failure to give adequate notice of termination, and termination in breach of the Employment Ordinance.
  • Advising clients in- and out-of-Court: We advise clients behind the scenes at the Labour Tribunal where no legal representation is allowed. In appropriate cases, we assist clients in transferring the case to the District Court or the High Court so that clients can benefit from legal representation.
  • Attending reconciliation meetings: We attend reconciliation meetings at the Labour Relations Division of the Labour Department, where potential claims by former employees can be successfully settled and costly, protracted litigation can be averted.
