At WPCL, our Litigation and Dispute Resolution Team possesses extensive experience in civil and commercial litigation. From small-scale matters to high-stakes disputes, we represent both local and overseas clients, catering to the needs of private individuals and corporate entities alike.
We understand the importance of assembling a skilled and multidisciplinary team to effectively represent our clients. Over the years, we have established strong connections with professional intermediaries, including private investigators, forensic accountants, restructuring specialists, mediators, arbitrators and barristers. By leveraging these connections, we ensure that our clients benefit from the collective expertise of professionals who are integral to achieving successful outcomes.
Our Experience
Our civil and commercial litigation practice spans a wide spectrum of legal matters, including:
- Contractual Disputes: We are adept at handling contractual disputes relating to, inter alia, goods sold and delivered and services rendered, agency, licensing and franchising and long-term cooperation and distribution agreements.
- Corporate Disputes: We are regularly instructed to advise on shareholders, partnership and joint venture disputes and claims against directors for breaches of fiduciary duties.
- Debt Recovery: We regularly act for listed financial institutions and money lenders in the recovery of outstanding debts. Our clients also include high-net-worth individuals, notably from Mainland China, who invested in Hong Kong listed company bonds for residency under the Capital Investment Entrant Scheme. We help them recover their debts when the listed companies default on repayment.
- Enforcement of Foreign Judgments and Arbitral Awards: We work closely with lawyers in the Mainland China, the ASEAN region and abroad to enforce foreign judgments and arbitral awards in Hong Kong courts.
- Internet Fraud and Asset Tracing: We understand the urgency inherent in internet fraud cases. We respond quickly and assist our clients in filing reports to the police and to the banks. To locate and preserve the proceeds of fraud, we also assist clients in applying to the court for disclosure orders, gagging orders and Mareva injunctions.
- Winding Up of Companies: We represent both creditors and financially distressed companies in winding up proceedings. We also advise on cross-border insolvency and restructuring matters.
- Defamation: Defamation, particularly in the online sphere, imposes severe and lasting consequences for individuals and entities alike. Our firm has extensive experience in representing professionals and businesses in defamation actions and has a proven track record of successfully requesting the removal of defamatory posts from online platforms.
- Non-Contentious Court Applications: Our Litigation and Dispute Resolution Team works closely with our Corporate and Commercial Team and Real Estate Team on non-contentious court applications, including, for example, the restoration of dissolved companies, rectification of Companies Registry’s records and removal of impugned filings, and the removal of old mortgages from the Land Registry’s record.
International Collaboration
Our reputation extends beyond Hong Kong, and we frequently receive instructions from law firms in Mainland China, the ASEAN Region and across the globe. We issue pre-action legal opinions on Hong Kong laws and serve as expert witnesses in court and arbitration proceedings, offering our local knowledge and insights to support clients globally.
